Members of the community have expressed concerns and disdain after an attorney who allegedly entered his ex-girlfriend’s place of employment and tried to shoot her was rapidly released from custody on a bond.

Late in the morning on November 26, at the Anderson Mill Pub in northwest Austin, the bartenders were serving a few customers when a man walked into the establishment.

Some of the customers recognized the man as the recent ex-boyfriend of one of the bartenders who was working a shift that morning.

After the police responded to a call from a woman claiming her ex-boyfriend was about to take her life, they learned that she had falsely accused the man, but they unexpectedly detained a fugitive.

On December 4, the Pueblo Police Department was notified about a potentially harmful domestic violence matter between a woman and her ex-boyfriend, and it reportedly involved a gun.

The woman said she was trying to stay out of sight but claimed that her ex had a firearm and he was making threats to kill her.

After the father of her child ended their relationship, the mother of a newborn reportedly ditched the baby at a stranger’s residence and ran away.

33-year-old Melissa Kelley lives in Astor, Florida, and she recently gave birth to a son.

Kelley and her son’s father ended their relationship, and the woman was reportedly very emotionally distressed over the breakup.

In nearly twenty years of practice as an Orange County criminal defense attorney, I have seen the following too many times to recall:

He has been served with a temporary restraining order and wants to fight it. The says there’s no reason for it. They simply had a breakup and he said some mean things. There was no violence, no harassment and no threats. Imposition of the restraining order can have consequences- he could lose his job and his ex-wife could use the restraining order against him if she ever decides to take him back to court to get more child support. Shortly before the restraining order hearing he calls and says his ex-girlfriend wants to “drop” the restraining order. I ask how he knows this and he says “she called me”.

He should never have taken that call. Unless there is some specifically carved out exception such as “the parties may have electronic communication solely for the purposes of discussing continuing financial obligations,” a restraining order prohibits contact for ALL  purposes.
